All advertising published within the web pages owned by the Open Photographic Society (OPS) is subject to the following terms and conditions:
- All advertising material is subject to approval by the Open Photographic Society (referred to below as “the Society”), which reserves the right to reject or cancel any advertisement deemed to be unsuitable for any reason.
- Fees paid for advertising are non-refundable unless relevant advertisements are cancelled prior to the commencement of the associated advertising campaigns. Commencement is defined as the moment an advertisement is first published on the internet.
- Advertising space is subject to limited availability and will be allocated on a first-come first-served basis. Once all of the available advertising slots are filled, further advertisements are queued (ie stored off-line) until the next available slot becomes available. The Society will notify advertisers whose advertisements are queued of the estimated time for publication of their advertisements, and also of the date they are actually published.
- These terms and conditions are subject to change without prior notice. Updates will be made available at www.openphotographicsociety.org.
- Rates (fees) are subject to change without prior notice. However, only new or renewed contracts are affected when rates change. Rates for existing contracts remain unchanged until the expiration date existing at the time of the rate change.
- Page views are defined as anytime an advertisement is displayed to a visitor of the Society’s web site.
- The Society is not bound to comply with advertiser instructions if they conflict with established policies.
- All advertisements are positioned at the sole discretion of the Society. Front-page advertisements are placed only on the home page of the Society’s website. Classified advertisements are placed in the category deemed most appropriate by the Society.
- By agreeing to these terms and conditions the advertiser, and any associated companies or agencies, acknowledge that they own the necessary rights and permissions to publish on the internet the submitted material. Each agrees jointly and severally to indemnify and save harmless the Open Photographic Society against all damage, loss, expense and liability of any nature arising from our use on the website of the advertiser’s submitted text, images or graphic content.
- Whilst every reasonable effort will be made to avoid mistakes and omissions, the Society assumes no liability for errors in materials. All attempts will be made to correct as soon as possible any errors that may be published.
- The Society reserves the right to refuse or postpone the display of submitted advertising content until all relevant payments have been received in full (including processing credit card transactions, those made Paypal, and the clearing of bank cheques where this is relevant). The Society also reserves the right to delay publication of submitted material until advertising space becomes available.
- The Society will not accept liability for delays in publishing or failure to publish submitted advertising content in the event of circumstances beyond its control, such as website or server down time.
Receipt by the Society of either submitted advertising material or the payment of fees constitutes acceptance of these terms and conditions by the advertiser and any associated companies or agencies.
